Апелляционный суд должен повторно рассмотреть дело в свете решения Верховного суда по делу Southwest Airlines Co. v. Saxon, о котором мы писали в июньском дайджесте. Данное решение отличается, например, от вынесенного в начале года решения американского суда, о котором мы рассказывали в дайджесте за январь. В решении суд указал, что пользователь присоединился к арбитражному соглашению, два раза кликнув утвердительно, соглашаясь на пользовательское соглашение и на создание аккаунта, независимо от факта прочтения пользовательского соглашения. Делопроизводство, связанное с приведением в исполнение судебных актов арбитражных судов

Mute Off Thursdays, сообщество, занимающееся продвижением гендерного равенства в международном арбитраже, выпустило сборник женщин-арбитров. В сборнике представлены женщины-практики в области международного арбитража со всего мира с указанием опыта, специализации и навыков. Многолетний спор между Индией, инвесторами и правопреемниками мавританской компании Devas Multimedia, по которому уже было вынесено два арбитражных решения, и не думает заканчиваться. Суд сослался на решение 1960-х годов, в котором суд постановил, что европейское законодательство о конкуренции является частью публичного порядка Германии. Кроме того, поскольку правила добросовестной конкуренции являются фундаментальной опорой немецкого экономического и социального порядка, Федеральный суд заявил, что не может согласиться с каким-либо неправильным применением этих правил третейским судом.

Назначение в инвестиционном арбитраже

На данный момент (статья писалась 2 октября 2012 года) назревает ситуация (видно в конце графика) когда возможно будем иметь место арбитражная сделка, где продаваться будет фьючерс на акции ЛУКОЙЛ, а покупаться фьючерс на акции ГАЗПРОМ (на рисунке ситуация выделена синим). Данное положение не применяется в случае возврата исполнительного листа отделением почтовой связи в связи с невозможностью его доставки адресату (пункт 17.15 Инструкции). Выдача исполнительного листа об обеспечении иска по ходатайствам нескольких заявителей производится заявителю, чье ходатайство поступило в суд и было зарегистрировано первым.

Английский суд выдал антиисковый и антиисполнительный запреты в пользу банка Barclays в споре с российским банком ВЭБ (Barclays Bank plc v. VEB.RF). Указанный спор возник из Генерального соглашения Международной ассоциации свопов и деривативов, которое предусматривало разрешение всех возникших из него споров в LCIA. В 2019 году Barclays и ВЭБ внесли изменения в Генеральное соглашение, в соответствии с которыми оно могло быть расторгнуто, если против ВЭБ будут введены санкции Великобритании. Впоследствии SICC вынес окончательное решение об антиисковом запрете в отношении судебного разбирательства в Филиппинах.

Суд, проанализировав арбитражные оговорки, пришел к выводу о том, что они не являются совместимыми, а следовательно, на основании этих оговорок нельзя было инициировать единое арбитражное разбирательство. Учитывая, что разный круг лиц имеет право участвовать в формировании состава арбитража по трём документам, из которых был инициирован арбитраж, невозможно прийти к выводу о том, что спор может рассматриваться в рамках единого арбитражного разбирательства. Один из заемщиков не был стороной второй обеспечительной сделки (и потому не мог участвовать в формировании состава арбитража по соответствующей арбитражной оговорке в нем), когда как лица, предоставляющие обеспечение, не могли участвовать в формировании состава арбитража по договору займа и первой обеспечительной сделке. Исходя из этого, навязывание единого арбитражного разбирательства, по мнению суда, нарушает принцип автономии воли сторон, а также предоставляет займодавцу преимущество при формировании состава арбитража. Инициируя арбитраж, займодавец получил право номинировать арбитра, когда как ответчикам требовалось номинировать арбитра совместно, что они не смогли сделать. В случае если исполнительный лист был возвращен в суд первой инстанции в связи с его исполнением (добровольным или принудительным), невозможностью исполнения, он должен быть погашен.

Гонконгский международный арбитражный центр (HKIAC) опубликовал новый Арбитражный регламент, который вступил в силу 1 июня 2024 года. Журнал учета бланков в этом случае прошивается, листы нумеруются работником, ответственным за ведение таких журналов. Количество листов в каждом журнале заверяется на последней странице подписью начальника подразделения, ответственного за делопроизводство, и оттиском печати соответствующего суда. Бланки исполнительных листов до их выдачи сотрудникам арбитражного суда, ответственным за изготовление исполнительных листов, хранятся в металлических шкафах, сейфах и (или) в помещениях, специально оборудованных охранной сигнализацией и средствами пожаротушения в условиях, исключающих их порчу и хищение.

Мотивированное определение изготавливается в течение пяти дней со дня поступления соответствующего заявления. Срок на обжалование этого определения исчисляется со дня его изготовления в полном объеме. РИСА считает, что сегодня особенно важны образовательные проекты, основанные на ценностях мирного урегулирования споров. Поэтому команда РИСА решила продолжить проект и в этом году сделать участие в нем полностью бесплатным. В то же время некоторые эксперты считают, что единственная реальная причина, по которой государства-члены ЕС выходят из ДЭХ, заключается в их желании уклониться от своих обязательств по выплате компенсаций в случае нарушения прав инвесторов по ДЭХ.

Оптимизация нагрузки и ликвидация явно абсурдных дел могут стать одним из первых шагов в этом направлении. День выдачи копий судебных актов, исполнительных листов, других документов назначается ответственным работником, исходя из готовности соответствующих документов, с учетом сроков изготовления судебных актов, установленных АПК РФ. Для иногородних представителей и граждан выдача документов (по возможности) производится в тот же день. Текст исполнительного листа печатается через 1 – 1,5 межстрочных интервала, шрифтом Times New Roman, черного цвета, размером от 10 до 14, на расстоянии от левой границы текстового поля – 30 мм, от правой – 15 мм, верхней и нижней – 20 мм.

Спикерами вступили медиаторы Центра медиации «Solis» Дарья Ждан-Пушкина, Полина Кондратюк и другие практикующие юристы, а также правовой советник РАЦ Константин Цымбалов. В ходе выступлений участники обсудили как отдельные методики в работе медиаторов, так и перспективы регулирования, в том числе особенности национального и международного режимов исполнения медиативных соглашений. Кроме того, были затронуты темы эффективной коммуникации, урегулирования конфликтов в бизнесе и личной жизни.

SICC указал, что ответчик при этом не лишен права оспорить признание и приведение в исполнение решения SIAC в Филиппинах. Суд также подчеркнул, что арбитражные разбирательства неизбежно затянулись бы, а их ход был бы неоправданно затруднен, если бы стороны имели возможность оспаривать постановления о принятии обеспечительных мер. По мнению суда, запрет, хоть и вынесенный в форме арбитражного решения, по существу является временным постановлением и, следовательно, не подлежит оспариванию. Договор займа содержал арбитражную оговорку, которая предусматривала, что спор должен быть рассмотрен тремя арбитрами, один из арбитров назначается заемщиками совместно, когда как другой арбитр назначается займодавцем. Если два арбитра не могут выбрать председателя состава арбитража, то его назначает HKIAC. Арбитражные оговорки в обеспечительных сделках были идентичными и предусматривали, что условие о разрешении споров в договоре займа применяется к ним mutatis mutandis.
